I think @deanosaur meant to say was he could put the current capital tied up in ASM shares to better use within his portfolio and that should his view or portfolio needs change at some time in the future, he would consider investing again in ASM.
That is unlikely to be considered a wash sale, nor should it ever be viewed as one as the basis of the decision is entirely from the perspective of capital and portfolio management.
It is the corollary of many of us here who sold at $8 - $10 as the stock approached a full value and now find ourselves attracted at around $1.50. Tax is a secondary consideration to most investors, making money or not losing it is paramount.
For what it is worth, ASM is not likely to knock the lights out in the next 6-12 months as offtake agreements require a lot of things to be right for many parties. No one should be expecting a massive price run up a la 2021 style. Nevertheless, over a 2 - 3 year time horizon, my view is that the development of its new technology and REE capabilities will create a lot of value for all stakeholders.
