This ASIC case is about the disclosure of material information NOT about the validity of the performance shares. and
"ASIC position is that the revenue was valid and the performance shares were appropriately issued"
Both statements are categorically untrue. ASIC have alleged breaches of the corporations act which saw the performance hurdles met and the performance shares issued, that this was done to benefit JK and others and was against the best interests of shareholders. It's all there in black and white in the SOC perhaps take your own advice and read the SOC. Happy to paste the sections (again) if you don't believe me.
