Some insight can be gleamed from the Intec investor question and answer forum. You can find conversations between shareholders and INL management on the impact of the convertible note arrangement with La Jolla.

Shareholders paid a heavy price, though without La Jolla INL may have not survived.
Of course this agreement could be different. EDE may find itself in a position to pay out any outstanding debt rather than converting (if the share price falls significantly).
