That is hard to argue in spx favour even if a spx Director was talking to patina because no spx Director can do formal talks of acquisition without the knowledge of other directors- adams and bosio’s position become more indefensible imo. In fact he was ‘coveting.’ If your neighbour was coveting your wife, has he broken the Australian law? Hewlett coveting the asset was all in his imagination it would seem. But Bosio and adams appear to be in pear shape from more angles I look than otherwise. They’ll be asked to testify under oath. And The records are all in the storage systems whether it’s emails or phone conversations. Nothing they can hide except covetousness. I’d expect this ends up in a settlement, most companies want to avoid costly litigation
