About the case - Exploitation concession for the Norra Kärr project

In April 2014, Visingsörådet submitted an application to the Supreme Administrative Court (HFD) in which we demanded that the government's decision regarding the exploitation concession be revoked. HFD issues leave to appeal 2014-09. HFD announced the following judgment on 22 February 2016 (case no. 2047-14).

A permit for a exploitation concession according to the Minerals Act did not include facilities necessary for operation. This limitation has meant that an overall assessment of the activity's impact on neighboring Natura 2000 areas has not been made. Legal review.

The government lost (we won) in the HVD, which resulted in changes to the Minerals Act (ML). The HVD's court decision thus resulted in the responsible authorities already in the permit process for exploitation concessions having to test the entire mining operation concerned and not only test the impact of the mining area as before.
