On available info, it's a pretty straightforward breach of confidence which you'd think they'd have to try to settle in my opinion. SPX's only hope would be to find technicalities in the wording of the confidentiality agreement looking at the claim, but even that might not be enough.
If the key details in that claim are true, I don't see how they can get out of it unscathed.
