Having done quite a few Mining Industry Confidentiality Agreements there is one glaring problem with almost all of them. Information already in the Public Domain is invariably excluded in these agreements. Penny West was always famous for its stunning average mined grade of about 21 g/t. The Mines Dept Tengraph portal, MTO Mineral Titles online and others such as Geoview all readily show who the owners are of any tenements in WA.
SPX will have a very strong case to say Penny West being so clearly in the public domain is excluded from any such agreement with Venus Metals.
I think Venus may be hoping to catch comet here and maybe can extract a settlement but might also get badly beaten and end up paying all court costs much like happened with Kidman as it was awarded costs. Those buying Venus might want to swap to buying SPX.
