I just smell incompetence and its a pretty rank smell atm.
An 'incomplete negotiation'
'material customer contract ...ceased to be confidential'...ffs
- the potential partner has just gained significant leverage - the fact that a company was named has inferred significant reputational damage to that potential customer .... ceased to be confidential....
its perhaps relevant to understand that a confidentiality agreement would have been in place and a remedial response to the 'injured party' is actionable ...they are nominated as express duties of remedy and / or equitable duties of remedies....
the next 5 business days will be busy times across the negotiating table I suspect in light of the above - time will reveal the outcome.
