Read it properly please. All of conditions 3.1A.1, 3.1A.2 and 3.1A.3 need to apply at the same time. 3.1A.1 applies if any one of 5 conditions listed in it applies. That doesn’t obviate the need to meet 3.1A.2 and 3.1A.3 as well. Furthermore the ASX have to be consulted and convinced that a piece of information remains confidential before 3.1A.2 can be satisfied.
So, as I said, if it’s price sensitive information, it pretty much has to be disclosed. Rule 3.1A is of very rare application indeed.
