Wrong. It is not muddle headed. The rule is about when information can be withheld from disclosure which covers confidentiality.
so, as with so many here, read the rule properly. It states clearly that the test is that the reasonable person would not expect the information to be disclosed. That is a wider test than you suggest. See GN8.
