Yeah I was concerned about that as well. The main patents ran out a long time ago so anyone could build one and they have not, there are many other patent improvements but still that no one at all has used it is surprising. I believe Ross's claims of strong patent protection are simply untrue when the primary patent expired a decade ago, if anyone else know the patent situation better please chime in and correct me if I am in error.
Their best asset will be the modularisation they spent many years on. If it works it will be worth big bucks as finally anyone can buy one off the shelf and deploy. Its like Apple's iPod, there were tons on MP3 players on the market but the best they could do was be niche players until Apple showed them how to package and sell it.
I think the same can apply in this context as well.
