Attorney-General Mark Dreyfus has launched an inquiry into inequality, unfairness and weaknesses in native title laws, which comes amid an investigation published this week by The Australian Financial Review.

The terms of reference drafted by Mr Dreyfus ask the ALRC to consider the original intention of the Native Title Act, as stated in the act’s preamble, to be a special measure for the advancement of First Nations peoples.

It asks the inquiry to consider how best to rectify inefficacy, inequality or unfairness in Indigenous land use agreements and related parts of the act, including how economic development could be better pursued.

Mr Dreyfus said the review should be conducted with regard to the socio-economic outcomes and priority reforms of the Closing the Gap targets, which have reported poor outcomes for Indigenous Australians.
