Sorry but the 'once empowered, always empowered' decision only relates to mining rights granted before the 2018 mining charter was introduced.
As the article states: "The Minerals Council South Africa has instituted a judicial review challenge seeking the review and setting aside of certain clauses of the Mining Charter 2018 and specifically clauses imposing new BEE ownership obligations on holders of existing mining rights in the case of renewals and transfers of their existing mining rights."
So we need to wait for the High Court's decision on the Mining Charter 2018 to know what BEE requirements apply to WWI. Also worth noting that the Mining Charter says that companies may have to provide 10% of their equity free of charge to local communities. Therefore it's likely that WWI's stake in the mine will be further diluted.
