you can't deem this to be a breach of confidentiality without knowing the terms of the agreement in place, most likely a reasonable/legally acceptable agreement would take into consideration that in the case of an ASX query disclosure would be essential, in any other case, it would not. I don't know the terms but i don't suppose you do?
