Did anyone get to the bottom of why the PE arbitration failed? In a company acquisition situation, many JOAs specify that sufficient information is required to be provided to value the asset subject to PE where it is part of the company acquisition. I thought that FAR's contention was that this information was not provided.
Sorry for raking over the coals, was just curious whether any detail regarding the arbitration decision has ever been given.
Hugely disappointing outcome which could have been much different if the cards were played differently. CNs position along with some Directors is now untenable.
Did anyone get to the bottom of why the PE arbitration failed?...
