ESR doesn’t need to prove a resource exists — they’re not the ones mining it. The legal obligation falls squarely on Auric. If lithium is encountered and ore is disturbed during gold mining operations, then under the court order, Auric is responsible for processing it and paying the royalty. That's the whole point of this dispute.

The idea that ESR would have “fought harder” if it was valuable misunderstands the legal position. ESR already *secured* the rights years ago. Now it’s just about enforcing those rights when another company thinks it can dig through them for free.

This isn’t about whether ESR sets up a lithium plant or proves an economic deposit. It’s about whether Auric mines through known lithium-bearing zones and tries to dump or ignore what they extract. They can’t — not without breaching royalty obligations.

If you think a court will let them mine through a lithium zone, disturb ore, and toss it aside without consequence — that’s delusional.

Auric will settle this. Quietly. Out of court. Because the legal exposure, even in the “best case scenario” — is not worth the headache or the headlines.

So? Two outcomes here. Proving the existence of lithium falls on AWJ (and their geos). I promise they will drill wherever they have to drill to never encounter any lithium. Or ESR proves the existence of the lithium. Are they going to invest millions in drilling to define the resource just so they can claim royalties.

Money grab, as they pointed out above.
