In Western Australia, if a mineral by-product is not mined from a tenement, you are still required to lodge a quarterly production report and may be required to pay royalty if the by-product is produced or obtained, even if not sold. However, a "nil report" can be lodged if no production occurred. Penalties may apply for non-compliance with royalty obligations, including forfeiture of the tenement or a financial penalty.
