One possibility is that the Writ of Replevin is a claim under statutory law and under that statute there is that option for the defendant to post the bond. However, it appears that Yowie also applied for an injunction which is a different claim under equity. If that is the case, while Whetstone may have been able to stay the Writ of Reprevin, Yowie may still be able to enforce the equitable injunction that appears to have been ordered.
