agree if the generic term is used, NXS may not have a leg to stand on - based on a very technical interpretation of the agreement. And we sometimes court cases turns on just the interpretation or meaning just a few words.

There may be a reason NXS has not opted to use Zimmermann in the first place. Their independent agent force are probably more incentivised to sell and get results than Zimmer (albeit at higher commissions) and maybe NXS has looked to Zimmers prior track record in selling other NXS products - which from memory doesn’t seem that impressive yet.
