A dissappointing 24 hours for a potentially great company. Let's hope a satisfactory deal is done because I certainly don't want to have to endure a couple of years of uncertainty if this has to go to court, even though, judging by NXS's actions both recent and over the last few years there appeared to be "no intent" (part of basic contract law) to distribute Xperience through someone else. NXS, from my recollection, always said that they were looking for like minded partners to distribute through and then eventually decided to go on their own. From where I stand that doesn't look like they intended to licence it to someone else (IMO). Having said that I think the best option for us all at this stage (my thoughts) is to make a deal, with conditions. If they don't deliver significant results in terms of sales within two years, show em the exit door, and pick up where NXS just left off.
