Look at it this way, you have a distribution agreement to distribute Mazda 3's, they release a new model every 1-2 years I'd day, they need to get each new model tested and approved for sale right? No different here. Unless the contract said any product which obtains a new FDA approval is excluded then don't have much of an argument.
