Exactly. If Zimmer have 100% exclusivity, it shouldn't be too hard to prove without going to court.
And they can't be exactly sure of their position if they want to continue current negotiations.
A bit of one-upmanship game playing on Zimmer's part in order to gain the upper hand in negotiations.
