I'm just reading the Australian law and they say that a trade maker can be removed if the company doesn't use this for 3 years. On the Zip announcement they specify that Firstmac stop using it before 2013.
In the last paragraph Zip will take action against Loans.com.au (which is a subsidiary of Firstmac) in relation to home loan and debit card being promoted by reference to"ZIP".
It's annoying but sound like Zip management got everything under control.
