Even with fda approval, one needs to be able to prove that they can make enough of a product to be able to sell. The CE Mark, which is less about proving the "drug" as such, but more about the overall product, production, selling and marketing etc.
As I mentioned, the scary things are ok (ie is it a device, does it work, is it safe...)
