Notice of status of defeating conditions and lapse of offer in relation to
Fusedale Australia Pty Ltd and Rey Resources Limited

Dear Sir / Madam
We refer to the takeover offer (the Offer) of Fusedale Australia Pty Limited
(Fusedale) for all the ordinary shares in Rey Resources Limited (Rey).
Attached is the Notice of the status of defeating conditions required by the
Corporations Act.
Fusedale will not be waiving any conditions to the Offers in Fusedales bidders
statement (including the prescribed occurrences condition in section 9.7.9 which has
been breached as a result of the December share issue by Rey and the 90%
minimum acceptance condition). Other conditions have not yet been fulfilled and are
not expected to be fulfilled by 15 January. In light of this, Fusedale will allow its
takeover Offer to lapse on the scheduled closing date of 7.00 pm (Sydney time) on
Friday 15 January 2010.
Rey shareholders who have accepted Fusedales Offers will retain their shares after
the offer lapses on 15 January 2010 and will be free to deal with their ordinary shares
in Rey as they see fit.
