Liquidation is not possible. With IFCA cash Chemeq can pay its bills when they fall due, and that includes paying out Stark.
Today's decision is a status quo one - the judge refused to make a ruling to allow Chemeq to proceed with the IFCA deal at this time. If IFCA really have the money, then they will find a way of completing the deal. ALPS is a reputable bank. There is probably a restriction on the other bank being named under present circumstances; a way round that can be found.
There is no doubt Stark has always wanted the company and not the cash. The possibility of being paid out was the gamble they took when they issued the redemption notices. And now that gamble looks like being lost.
