Matters in Relation to Supreme Court of NSW Action
Today, Justice McDougall handed down his decision in the New South Wales Supreme Court action instituted by Fuji Xerox Australia Limited (FXA) against CSG Limited (CSG). His Honour found that FXA had validly terminated the Brisbane and Maroochydore dealer agreements with CSG. His Honour made orders which relevantly require CSG to provide FXA with signed deeds of novation in favour of FXA which FXA can forward to customers which CSG services in Brisbane and Maroochydore for their signature. In order to be effective, these deeds of novation require the customers consent and signature. Accordingly, the impact this will have on the CSGs business will depend on the number of customers in Brisbane and Maroochydore who consent to the novation in favor of FXA or choose to stay with CSG. CSG has determined that it will appeal this decision and will seek a stay of the orders pending appeal. CSG remains a dealer of FXA in Darwin and continues to service FXA products. CSG will also continue to sell and service Canon products in Brisbane, Sydney, Melbourne, Adelaide, Canberra and Perth.
