Interesting few paragraphs on the writ against former Wescone vendor: “ The Company considers that this $4.3 million (Wescone) Goodwill loss equates to the damage endured by the Company caused by the non-disclosure by the Wescone vendor of BHP’s desire to displace the Wescone W300-3 crusher with an alternative crushing solution. BHP communicated this to the Wescone vendor in 2015/16 confirming that the Wescone W300-3 was no longer a technically viable solution for BHP. This value damaging fact was not disclosed to the Company by the Wescone vendor during acquisition due diligence or prior to acquisition settlement in 2018. This circumstance is the subject of a WA Supreme Court Claim against the Wescone vendor by the Company”
