You seem to have a misconception as to what "opening the books" means. It's not like the investigators have a search warrant to go where they please and access whatever they want. They still have to ask for what they want to see, and the managers still have the opportunity to show the answers and how much detail they want to disclose.
And why are you so afraid of the share price "tanking" to $5 or less? That's where it was before the bid was announced. It wasn't a problem then. If the bid goes away the share price will return to its former level. So what?
