    The Appeal was bit of an anti-climax.
     
    Our barristers performed superbly and was very pleasing to see. What was also very pleasing is the judges listening and giving time to our legal team in deliberating - this was all we wanted.
     
    ALL there believed we won it.
     
    But unfortunately Sumitomo deliberately dragged on in their submissions thereby avoiding a decision this week. the remainder of the submissions will be done in writing. Result due 2nd or 3rd week of December.
     
    What is official is the removal of key landowners from the case who were originally supporting the Sumitomo. They had requested to be removed but after strong objection from Sumitomo the previous judge said he will decide that on Dec 6th. AVQ management put these removal requests forward to the panel of 3 appeal judges and they agreed for their removal from the case (even thou Sumitomo did everything to have them still part of the case). Therefore the High Court has to accept this as the Appeal court of above the High Court.
     
    Interestingly, the vast majority of cases on Appeal before the international judges were the same judge we had in our original High Court case.
