Stop Lynas Coalition had an extremely weak case when they applied for judicial review. The only allegation by SCL the judge took notice of was:
"there is an allegation of breach of the law in particular the Environmental Quality Act 1984 (EQA) when the TOL was approved without a comprehensive report on Environmental Impact Assessment (EIA) required under the law."
We all know this is a false allegation.
Since then the Minister for the MOSTI has rejected an appeal by residents on the grounds that their was no scientific or technical basis. Also a PSC has deliberated on the matter and the final recommendation is that Lynas should be issued with a TOL.
It is therefore extremely doubtful that any judge is going to agree to any application for judicial review or application for an injunction by SMSL. IMHO
