The arbitrator would be considering a number of issues - both real and potential. Having said that, I am not convinced that what is happening (or has happened) with Mylan's operations outside of the case with POH will make much difference - the POH case will have to be judged on its own merits alone I would have thought.
We just need to get the judge back from his oversea trip to make a damn statement on the case
