In the event the matter goes to court, then each party is obliged and required to give to the other all the information they have and intend to produce as evidence, prior to the commencement of proceedings.
The matter to consider then, is if the said material is eligible for use as evidence. It may be excluded if it was obtained illergally or in a way that is not acceptable to the court.
