By my observations there was some 107 million proxy's cast with about 44 million being directed directed to DP to vote with, the remainder some 63 million were directed to the chairman, these are the ones in question.

Should Justice Goldberg direct these to the applicant RC in that the chairman has to vote as stated on the proxy that will mean a change of Board.

On the other hand should he find in favour of the Defendant DP and allow the vote to stand the current board remain in control.

On my quick calculations the figures would be something like this. counted in 000's after finding difference between votes cast then taking proxy's minus 44,000 results would be as follows.

Res 4 Remove DP for 61,419,against 37,714 Difference of 23,709.

res 5 Remove MJ for 63,278, against 68,338 diff 5,060 MJ remain on board.

res 6 Remove DF for 63,374 against 54,501 diff 28,873

res 7 Remove KC for 63,518 against 52,574 diff 10,944

res 8 Appoint NS for 64,245 against 40,368 diff 23,877

res 9 Appoint PN for 63,374 against 49,971 diff 13,403

res 10 appoint ML for 63,446 against 52,449 diff 10,997

res 11 appoint RC for 64,072 against 36,218 diff 27,845

With the exception of res 5 all votes with 44 mil removed give a difference in excess of 10 mil which would be hard to peg back with the few odd thousands missing from these calculations.

This in effect on my calculations result in a change of board with one current member re elected.
Can I now sit back and await response from clever ones on my calculations.
