The reason any appeal from smsl after the 8th of Nov does not matter is that they will not be able to lobby for an additional stay before the Lynas plant is up and running, because due process will not allow enough time. Once the Lynas plant is up and running they know the game is over, because suddenly they must argue based on fact and not fear. Once it comes down to a true arguement of fact versus fear (i.e. once the plant is operational), then smsl suddenly run out of arguements. It is because of this that smsl are so terrified of the plant being turned on, because once Lynas goes live the company can prove the plant is safe and smsl's case falls apart.
