There are lots of things that are probably illegal, but only if the law is enforced and the consequences outweigh the benefits.
You also have to prove it! Court cases are expensive and how hard can it be for the world's largest banks and brokers to win? Some of them are many times more powerful than the Australian Government! They and their consulting firms (big 4) wrote the laws themselves!
