Pre-emption does not apply under those circumstances. In some situations companies may agree to have an AMI or are of mutual interest. This means that if a company succeeds in acquiring a permit then they will offer part of it to the other party. I don't think anything like this happened , otherwise they would have applied for the permits jointly which would have made more sense. I think there are more important questions to ask,......like why are our shares still being shorted mercilessly , and what is the true state , in plain English, of TO agreements ?
