AFTER settling his court dispute with developer Mirvac, coal baron Nathan Tinkler came out swinging yesterday, threatening to vote against chairman Mark Vaile and four other directors of Whitehaven Coal unless the company gave an earnings update at next week's annual meeting.

Mr Tinkler, who is Whitehaven's largest shareholder with a 21 per cent stake, wrote to the company yesterday threatening to vote against all five directors up for re-election at next Thursday's meeting, including Mr Vaile - a former deputy prime minister and a long-time associate of Mr Tinkler - and his own representatives on the board, Paul Flynn and Philip Christensen.

In a letter mailed yesterday and provided to Bloomberg, Mr Tinkler sought confirmation from Whitehaven on its estimated earnings and an update on the Narrabri and Maules Creek mines. He gave Whitehaven two days to respond. The company said yesterday the board was considering a response.
