Hi (again) guys,
Having just read more carefully the bidders statement from CFE to COV I can't see a 'defeating term' in Sec 10.8 that relates to a minimum % of shares that CFE needs in COV.
Unless I have missed something it would make an arbitrage play less risky and, if investors want to buy CFE shares there is an ability to do this more cheaply via COV provided you accept CFE's offer before the 11th September, and provided none of the other defeating terms have kicked in.
Seems good to me...
