When you say criteria the ATO "enforces", that can be misleading. What the law says is what counts, which is not necessarily what the ATO might or might not say in its handouts.
In the case of any "business", there is a huge body of case law that can be searched to find circumstances that may fit any particular dispute.
I've been out of the business for about 20 years but I doubt whether the fundamentals have changed.
