The plaintiff seeks declaratory relief against OPSL, and orders that OPSL and/or the ANZ parties return shares to the plaintiff or purchase replacement shares for the plaintiff plus damages, interest and costs.

Pleadings as between the plaintiff and the ANZ parties have closed and those parties are making discovery. The plaintiff’s application for leave to proceed against OPSL pursuant to s 440D of the Corporations Act is to be heard on 17 October 2008.
