In addition to ASIC, ANZ needs to start discussions with the ATO about the CGT issue. Clients will not settle with ANZ until the CGT issue is resolved.
I do not think full restitution of shares can undo the CGT event of the shares having been disposed this financial year. This is a CGT event and will have to reported by either clients or the ANZ to the ATO.
An ATO ruling may be needed to clarify.
