ASICs track record to date indicates it would not be capable of moving at the pace required to get an 'all in' case pulled together, before the various civil litigations are well under way.
Another problem is a few 'hard-core' clients who want their shares returned and damages for failed corporate deals because of what ANZ did with the shares...for example, Dr Soh, Melaware, Turpu, Beaconswood...they will want to go to trial regardless.
Then there are the vested interests of IMF and others to see this go to trial so they get a percentage of the pie...and the administrator who may not want to get a settlement as they may see this as a 'gravy train' for them for years to come...
IMO all the parties involved are 'thieves'...except the clients who appear to be the only 'innocents' in the whole affair...and this opens up a wider issue of what the 'system' has now become in Australia...where the 'innocents' are just lambs in a slaughterhouse.
