Patrick Mutz (PM) would have signed a confidentiality contract before he started working for Heathgate/Quaser.
There is no time limit, when confident information expires. Hence it is highly unlikely that any affidavit or information supplied by PM would be admissible in court. But if AGS could subpoena him to give evidence then any evidence he gives in the witness box becomes pertinent.
Something like this is the probable reason behind the legal argument over the wording of the Statement of Claim that is going on in the other court case at the moment.
The wording of the Statement of Claim will have a significant bearing on the outcome of the Deceptive or Misleading Conduct case.
H/Q were not happy with AGS’s initial draft of it. Which could mean something, but could also be mean nothing.
Patience is required while the court case process runs its course.
