my understanding of the aspen deal is that at this point, it is still non-binding.

I am not aware of the terms of the sale, but I presume that if they wanted to, that they could walk away.

From my reading of what is in the press, I am of the view that to avoid a breach of the loan covenants, they would need the sale contract to be binding.
