Well - as I see it Bantrybay in relation to this post
"As I see it, if you go to court and ask for X and Y, its not for the judge to run your business and give you X, Y and Z"
If you do go to court and X&Y are found to be illegal or non-binding etc - then any decision by X&Y to form Z would hence be subsequently deemed to be illegal, non-binding etc.
They should not have done this until the court decision was heard.
