As I understand it, bearing in mind I’m not a legal expert,my understanding is the arbitrator has it within his discretion to force full or partial costs, or waive them altogether depending on how things go (strength of claim, reasonableness of claim, delays, was bad faith shown etc). Bad faith is particularly interesting if the TTs are actually directly involved in proceedings - Rimfire lawyers could point to all the nonsense here as classic bad faith (IP tracking is a doddle).
Ultimately, though, you ideally just want sense to prevail and for common ground to be found, and let the drilling do the talking-there could be plenty here for everyone to fill their boots after all. On that point, I’m not exactly sure where we are in the program, would be good to find out actually, will do that!
