Read the judgement again, it's got nothing to do with the business. Even if there is an overhang (which is only speculation anyway), a bulk smaple permit and funding will bring in plenty of institutional investors who will eat up any blocks.
Just because there is a court case does not mean the issue is serious. It is simply a supression order, no more, no less.
