I think you're absolutely right that the AMX take-over is a contingency for the court-case failing.
However, I'm not sure that you can infer that having a contingency indicates they're confident or not confident that they'll win the court case. They're being diligent.
They're preferred outcome is obviously that they both win the court case and complete a full take-over of AMX.
From AMX share-holder perspective, it does seem now that the best option is for the take over to proceed and then hope the court-case rules in Centamins favor. Any other outcome short of a rival bid will see AMX SP go back down and who knows what next.
