Rules are made to be changed and broken. At the end of the day they are just a line drawn in the sand with someones interpretation of where the line in the sand is and what it means.
The very Nature of a QC is to exploit this Fact. There would be a Mountain of Laws that support the INTENT of a Rule. Rules that Protect Shareholders and also Companies.
The Political will and the Laws etc can be twisted 360 degrees in any direction depending on who is making the assumption of what a law or Rule means, or was intended to mean when it was written into law.
The Fact is that Arrium Australia has Australian Shreholders.
Arrium is Part of BHP but a spin off, Scomo has already said that there is ZERO chance the BHP will ever be based outside of Australia.
There is 4.2 BILLION dollars worth of Value in the Arrium Shares.
A 400 million dollar earnings , based on 2.8 billion shares equates to a $1.50c per share valuation on a PE of 10.
This Class Action of 4.2 Billion in Value will be the Largest Class Action in the History of Australia against the Government for Negligence for allowing Steel Dumping.
Its morally wrong, The Pub test alone is a growing force as it in itself determines the INTENT of what a Law should mean, and what a Rule should mean.
There is alot of Words in written laws and Rules.
A Queens Council, needs to only exploit just one written line of Law in order to exploit the INTENT of that law.
IMO the Government would be well aware by now that Arrium Shareholders have a Strong Case against the Gobvernment and KM as well as also the Banks.
What is right should prevail. The Shareholders have done no wrong.
But that cant be said for the Government, the Banks and KM.
